This habeas corpus petition has been preferred by the petitioner claiming that he has solemnized marriage with the daughter of the respondent No.4 and was living with her, but on 13.08.2021, the respondent No.4 and his family members have abducted his wife and now she is in their illegal detention, therefore, a direction may be issued to produce his wife before this Court.
Pursuant to the notices issued to the respondent Nos.1 to 3, learned Public Prosecutor has produced the corpus before this Court today through Police.
We have interacted with the corpus in camera and, thereafter, in the open Court and the corpus has stated that she is not under any illegal confinement of anybody and at present, she is residing with her parents and wants to live with them only.
Admittedly, the corpus is major and she has also asserted that she is giving her statements on her own free will and not under any pressure.
At this stage, learned counsel for the petitioner, on instructions, has submitted that he wants to withdraw this habeas corpus petition.
Accordingly, this habeas corpus petition is dismissed as withdrawn.
The police are directed to facilitate return of the corpus to the place of her choice.
