Thankamma vs Kerala State Road Transport Corporation and The Financial Advisor and Chief

P.N. Ravindran, J.—The Petitioner was injured in a motor accident that took place on 03.09.1997. She, thereupon filed O.P(MV) No. 433 of 1998 in the Motor Accidents Claims Tribunal, Pathanamthitta. By Ext.P1 award, passed on 07.12.2005, the Tribunal directed the Kerala State Road Transport Corporation to pay the sum of Rs. 11,000/- with interest to the Petitioner. It is stated that though Ext.P1 award has become final, till date, the Kerala State Road Transport Corporation has not deposited the amount awarded by the Motor Accidents Claims Tribunal, Pathanamthitta in O.P(MV) No. 433 of 1998.

Sri.V.V. Nandagopal Nambiar, the learned standing counsel for the Kerala State Road Transport Corporation submitted that the K.S.R.T.C will deposit the amount awarded by the Motor Accidents Claims Tribunal, Pathanamthitta within two weeks from the date of receipt of a copy of this judgment. In the light of the said submission, I dispose of the writ petition with a direction to the Respondents to deposit the amount covered by Ext.P1 award passed by the Motor Accidents Claims Tribunal, Pathanamthitta within two weeks from the date, on which, the Petitioner produces a copy of this judgment before the Managing Director of the Kerala State Road Transport Corporation. After such deposit is made, it will be open to the Petitioner to move the Tribunal for disbursement of the compensation.
