The proximate problem faced by the petitioner in this case is that the last date of application for enrollment, scheduled by the Bar Council of Kerala, is on 16.06.2022, but he has not been issued with his Provisional Degree Certificate yet.
The petitioner says that he has cleared all the papers - though he has sought for revaluation of certain papers of the 4th, 5th and 6th semesters, which have not been yet completed. He says that, therefore, he cannot be put to any further prejudice and that the University must issue him a Provisional Degree Certificate forthwith, so that he can apply for enrollment as an Advocate tomorrow itself.
Sri.Surin George Ipe – learned Standing Counsel for the University, in response to the afore submissions of Smt.Marian G.M.Tharakan – learned counsel for the petitioner, submitted that the revaluation of the 5th semester has been completed; while the said exercise in relation to certain papers of the 4th and 6th semesters are pending. He added that the statutory time frame for completing the same is not yet over.
As regards the Provisional Degree Certificate of the petitioner is concerned, he submitted that if he has cleared all the papers, then, notwithstanding the revaluation exercise, he can be issued Provisional Degree Certificate forthwith.
Resultantly, I order this writ petition and direct the competent Authority of the 2nd respondent to issue the petitioner the Provisional Degree Certificate; for which purpose, he shall remain present before them at 11 a.m. on 16.06.2022.
On the certificate being so issued, he will be at liberty to present it before the Bar Council of Kerala tomorrow itself, (16.06.2022) so as to enable him to apply for the ensuing enrollment without fine.
This writ petition is thus ordered; however, with an additional direction that the University shall complete the revaluation of all the papers of the petitioner without any avoidable delay, but not later than two months from today and thus leading to the grant of mark lists appropriately.
