Antony Dominic, J.—In the Ernakulam District School Youth Festival, Petitioner''s team participated in Vrindhavadhyam (Orchestra). They were given 3rd prize with A Grade. Aggrieved by the same, they filed an appeal, which was rejected by Ext.P1. It is challenging the above order and seeking a direction for their participation in the State Level Competition, the writ petition is filed.

The main contention raised in the appeal is that, on account of the fault of the sound system provided, the string of the guitar was broken resulting in the Petitioner''s team loosing first prize.

However, learned Government Pleader on instruction submits that no such incident was reported by the Stage Manager. If as a matter of fact, any such untoward incident had happened on the stage where the Petitioner''s team had performed, that would have been informed to the Stage Manager. That apart, it is seen from Ext.P1 order that there is a wide disparity of 23 marks as between the Petitioner and the first prize winner. In such circumstances, this Court will not be justified in interfering with Ext.P1.

Writ petition is dismissed.
