This MA has been filed by the applicants under Rule 4(5) of CAT (Procedure) Rules, 1987 for joining together in a single application. For the reasons
stated in the MA, the same is allowed and the applicants are permitted to join in a single OA.
OA No. 3000/2021
At the outset, learned counsel for the applicants submits that the relief sought in Para 8 (3) of the OA, i.e., “3. Quash and set aside the rejection
orders Dt.29.1.2021.â€, has been wrongly incorporated. He, therefore, does not press the said relief.
However, as regards the relief 8 (1) of the OA, i.e., “Direct the respondents to grant NFU to the applicants in the Grade Pay Rs. 5400/- from
the dates they completed 04 years continuous service in the Grade Pay of Rs. 4800/- irrespective of whether they attained the same by way of
promotion or ACP/MACP.†, we proceed with the matter.
At the outset, learned counsel for the applicants submitted that the applicants have already made representations dated 06.11.2020 and 02.07.2021
before the Respondent No. 3, which is still pending with them.
In view of that, learned counsel for the applicants submits that the applicants shall be satisfied if a direction is given to the respondents to consider
the case of the applicants and dispose of their representations within a time frame, as may be deemed fit and proper.
Accepting the prayer of the learned counsel for the applicants, without going into the merits of the case and without issuing notice to the
respondents, we direct the Respondent No. 3 to consider the case of the applicants and to dispose of their representations dated 06.11.2020 and
02.07.2021, by passing a reasoned and speaking order within a period of three months from the date of receipt of copy of the Order. This Order shall
be communicated to the applicant forthwith. This Order has been passed in the presence of Mr. R.K. Jain, learned counsel for the respondents.
With the above directions, the OA is disposed of at the admission stage itself.
