V.N.Public Health and Educational Trust, the petitioner herein, has established and is successfully running a 300 bedded hospital at Walayar. The

petitioner states that they intend to start a nursing college by name ‘PIMS College of Nursing’, offering 60 seats in B.Sc. Nursing. With the

above objective, Ext.P1 application was preferred before the 1st respondent for the issuance of Essentiality Certificate/No Objection Certificate. The

grievance of the petitioner is that no decision has been taken by the 1st respondent on their application despite the passage of several months. It is

contended that Ext.P5 reminder was sent but it was also of no avail. It is in the afore circumstances that the petitioner is before this Court seeking

issuance of directions to the 1st respondent to consider Ext.P1 application and to take a decision on the same within a time frame.

I have heard Smt. Anagha Lakshmy Raman, the learned counsel appearing for the petitioner, Smt.Nisha Bose, the learned senior Government

Pleader and Sri.P.Sreekumar, the learned Standing Counsel appearing for the 2nd respondent.

Having regard to the facts and circumstances and the submissions made across the Bar, I am of the view that this writ petition can be disposed of

directing the 1st respondent to take up Ext.P1 application with due notice to the petitioner and pass orders thereon, expeditiously, in any event, within a

period of one month from the date of production of a copy of this judgment. The petitioner shall produce a copy of the writ petition along with this

judgment before the 1st respondent for further action.
