Applicant Yuvraj Singh Bora @ Yogi is in judicial custody in FIR No. 295 of 2022, under Section 363, 366, 376 (2) IPC & Section 5/6 of the Protection of Children From Sexual Offences Act, 2012, Police Station Sitarganj, District Udham Singh Nagar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

It is argued that the victim as well as the informant both have not supported the prosecution case at trial. There is no biological, forensic or electronic evidence.

Learned State counsel admits it.

Having considered the entirety of facts, this Court is of the view that the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
