Judgment
The petitioners before this Court have done their Bachelor of Science in Medical Laboratory Technology (in short ''B.Sc.M.L.T.'') from Punjab Technical University. However, the petitioners now want to be appointed as a Lab Technician in the State Government Hospital; but, the difficulty before the petitioners are that they have not been registered with the Uttarakhand Para- Medical Council.
According to the petitioners, Uttarakhand Para- Medical Council and the State of Uttarakhand are sitting over the matter and have not taken any decision on this aspect till date. The petitioners have relied upon the decision of this Court passed in the matter of "Vinod Kumar Vs. State of Uttarakhand" (WPMS No.1434 of 2015 decided on 27.08.2015), wherein the petitioners allege that, under the similar circumstances, certain directions were given to Uttarakhand Para-Medical Council and the State Government of Uttarakhand.
Mr. P.C. Bisht, learned Standing Counsel for the State submits that the matter is exactly the same, as decided by the learned Single Judge in the above referred judgment.
Considering the submissions of the learned counsel for the parties, it is provided that the petitioners shall be at liberty to move a fresh application before the Uttarakhand Para-Medical Council for registration, annexing therein all the required documents and in case the Para-Medical Council is satisfied with the genuineness of the credentials of the petitioners, including the petitioners'' degrees and certificates, it shall forward the same to the State Government for approval alongwith its recommendation within a period of two weeks from the date of such application. Thereafter, the State Government shall take a decision on such recommendation as expeditiously as possible. It is, however, made clear that the Government shall consider the genuineness of the course of the respective Universities and also consider, whether the course is recognized as equivalent by the State Government.
In view of the above, the writ petition stands disposed of.
