Satish Kumar Mittal, J.—Petitioner Hakam Singh has filed this petition u/s 439 of the Code of Criminal Procedure for the grant of regular bail in case FIR No. 31 dated 27.2.2006 u/s 15/61/85 of the NDPS Act, registered at Police Station Kot Ise Khan.

I have heard counsel for the Petitioner and gone through the contents of the FIR as well as the order dated 14.12.2006 passed by Special Judge, Moga, whereby bail application of the Petitioner has been dismissed. In this case, 5 bags, each containing 30 Kgs. of poppy husk, are alleged to have been recovered from the possession of the Petitioner with his co-accused, when he was sitting in the canter. In view of the recovery and the provisions of Section 37 of the NDPS Act, I am not inclined to grant the concession of regular bail to the Petitioner.

Dismissed.

However, the trial court is directed to expedite the trial.
