Judgment
Accused in Crime No.198 of 2026 registered by Bommanahalli Police Station, Bengaluru City for the offence punishable under Section 80(2) & 85 of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail.
Heard the learned counsel for the parties.
FIR in Crime No.198 of 2026 was registered by Bommanahalli Police Station, Bengaluru City for the aforesaid offences against the petitioner, based on first information dated 21.06.2026, received from Sri Reddappa B, father of deceased Smt. Boode Gayathri. During the course of investigation of the said case, petitioner was arrested on 22.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.6285 of 2026 was rejected on 08.07.2026. Therefore, he is before this Court.
Perusal of the material on record would go to show that, the deceased is the youngest of the four daughters of the first informant. Her marriage with the petitioner was performed on 25.04.2026. At the time of marriage, family of first informant had allegedly given dowry to the petitioner in cash and kind. In the first information itself it is stated that, after marriage, for some time, the deceased had stayed in her parents house and the petitioner used to visit their houses on every weekend. On 08.06.2026, the petitioner had brought his wife Gayatri along with him and they started staying together in a house at Bommanahalli.
It is alleged that, prior to deceased committing suicide, she had informed her mother that petitioner was pressuring her to work in the house and in this regard, he was torturing her. On 18.06.2026, Gayathri had called her mother and informed her that, petitioner after abusing had assaulted her. It is alleged that, after marrying Gayathri, the petitioner was found roaming with his uncle's daughter and it is under these circumstances, Gayathri had committed suicide on 20.06.2026 by hanging herself.
There is no allegation in the first information that Gayatri was ill-treated in her matrimonial house in furtherance of demand for dowry. Investigation of the case is now completed and charge sheet is filed. Neither in the FIR nor in the charge sheet, the provisions of Dowry Prohibition Act, 1961 has been invoked against the petitioner. The petitioner, aged 25 years has no criminal antecedents. He is said to be an employee in a private bank. Under the circumstances, the following :-
ORDER
Criminal petition is allowed.
The petitioner is directed to be enlarged on bail in Crime No.198 of 2026 registered by Bommanahalli Police Station, Bengaluru City for the offence punishable under Section 80(2) & 85 of BNS, 2023, subject to the following conditions:
The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
The petitioner shall not involve in similar offences in future.
The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
