Heard the learned counsel for the parties.

FIR in Crime No.354 of 2025 was registered by Nandini Layout Police Station, against the petitioner herein for the aforesaid offence, based on the first information dated 07.12.2025 received from Smt. Sowbhagya S M -mother of the deceased - Mallaiah Nisha Tammaiah.

During the course of investigation of the said case, petitioner was arrested on 07.12.2025 and remanded to judicial custody. After completing investigation, charge sheet is filed against him for the aforesaid offence. His bail application filed before the Jurisdictional Sessions Court in Crl.Mis.No.4897/2026 was rejected on 17.06.2026. Therefore, he is before this Court.

First informant in the present case is the mother of the deceased - Mallaiah Nisha Tammaiah, who was the wife of the petitioner. The material available on record would go to show that deceased, who was in love with the petitioner had voluntarily left her house, gone with the petitioner and had married him. First informant had therefore filed a missing complaint on 14.10.2025. Subsequently, the missing girl had called her mother and informed that she had married the petitioner and she has no intention to return home. On 06.12.2025, Mallaiah Nisha Tammaiah had committed suicide by hanging herself.

Allegation against the petitioner is that he was often quarrelling with his wife for the reason that she did not know to cook and do other house hold work. Petitioner who has no other criminal antecedents is in custody for the last more than 9 months. Investigation of the case is completed and the charge sheet is filed. Considering the nature of allegations found in the charge sheet against the petitioner, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively.

Accordingly, the following order:

O R D E R

(i)

The Criminal Petition is allowed.

The petitioner is directed to be enlarged on bail in S.C.No.664 of 2026 pending before the Court of XLV Additional City Civil and Sessions Judge, Bangalore, arising out of Crime No.354 of 2025 registered by Nandini Layout Police Station, for the offences punishable under Section 108 of BNS, 2023 subject to the following conditions:

a)

The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b)

The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

c)

The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

d)

The petitioner shall not involve in similar offences in future;

e)

The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed of.
