Judgment
Ashok B. Hinchigeri, J.—Heard the learned advocates, Sri V. Lakshminarayana for the Petitioners, Sri H.T. Narendra Prasad, Government Pleader for the Respondent Nos. 1 and 2, Smt. M.P. Geethadevi for the Respondent Nos. 3 to 7, Sri Manmohan for the Respondent No. 8 and Sri M.C. Jayakeerthi for the Respondent Nos. 9 to 10.
I am disinclined to entertain these petitions on the short ground of the availability of alternative remedy. Keeping all the contentions (including the ones pertaining to jurisdiction) open and reserving the liberty to the Petitioners to avail of the appeal remedy, these petitions are disposed of.
To safeguard the interests of the Petitioners during the interregnum, that is, between today, the date of disposal of these writ petitions and the date of disposal of the anticipated appeal to be filed by the Petitioners, this Court also deems it necessary to continue the effect of status-quo. All the parties are directed to maintain status-quo for a period of three weeks or until the disposal of the Petitioners'' anticipated appeal, whichever is earlier.
Sri V. Lakshminarayana, the learned Counsel for the Petitioners submits that the Petitioners would have the copies of the appeal memorandum, stay application, etc. served on the learned advocates appearing for the Respondents in this case and file the appeal before the Appellate Authority (Government of Karnataka) on Saturday, the 18th instant. The learned advocates appearing for the Respondents submit that they would appear before the Appellate Authority on Monday (20-12-2010) at 3.00 p.m. without waiting for any notice from the Appellate Authority. These submissions are placed on record.
The Appellate Authority is directed to dispose of the main matter, i.e., the anticipated appeal as expeditiously as possible and in any case, within an outer limit of three weeks. All the parties are directed to co-operate with the Appellate Authority in the speedy disposal of the matter by not seeking the adjournments unnecessarily.
No order as to costs.
