Judgment
Accused in S.C.No.500/2026 pending before the Court of XLV Addl. City Civil & Sessions Judge, Bengaluru, arising out of Crime No.322/2025 registered by Koramangala Police Station, Bengaluru City, for the offences punishable under Sections 109(1), 78(2) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.
Heard the learned Counsel for the parties.
FIR in Crime No.322/2025 was registered by Koramangala Police Station, Bengaluru City, initially for the offences punishable under Sections 351(2), 74, 78(2) of BNS, 2023, against the petitioner based on the first information dated 18.12.2025 submitted by Ranjini who is the alleged victim in the present case. During the course of investigation, petitioner was arrested on 19.12.2025 and remanded to judicial custody. His bail application filed before the Trial Court in S.C.No.500/2026 was rejected on 20.06.2026. Therefore, petitioner is before this Court.
The material on record would go to show that petitioner and the victim were loving each other. Subsequently, because of certain difference of opinion, their relationship had failed. On the alleged date of incident, petitioner who had confronted the victim, had abused her, and thereafter tried to commit her murder by strangulating her neck. It is under these circumstances, FIR was registered against the petitioner.
Investigation of the case is completed and charge sheet has been filed. Petitioner who has no other criminal antecedents is in custody for the last more than six months. Considering the aforesaid aspects of the matter and the nature of allegations found in the charge sheet, petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly the following order:
The Petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.500/2026 pending before the Court of XLV Addl. City Civil & Sessions Judge, Bengaluru, arising out of Crime No.322/2025 registered by Koramangala Police Station, Bengaluru City, for the offences punishable under Sections 109(1), 78(2) of BNS, 2023, subject to the following conditions:
Petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with one surety for the likesum, to the satisfaction of the jurisdictional Court;
Petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts her appearance for valid reasons;
Petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
Petitioner shall not involve in similar offences in future.
